What you're buying

You are buying placement of your artwork on the specific squares you choose on the car's wrap for the duration of the journey. You are not buying any ownership in the vehicle.

Review and refunds

If your artwork is rejected for any reason, you may request a full refund; otherwise, we will wait for updated artwork to be put in its place.

Once artwork is approved, it will appear on the virtual vehicle on the themilliondollartesla.com home page, along with all associated story and links. Refunds requested at this point will be subject to a cancellation fee not to exceed 10% of the price paid for the space.

Once the vehicle has been wrapped, no further refunds will be available.

Your artwork

By submitting artwork, you represent and warrant that you own it or have obtained all permissions, licenses, and releases needed for MDT to use it as described in these Terms. This includes rights to any logos, trademarks, photographs, text, names, likenesses, and other material included in the artwork. If you submit artwork on behalf of a business or another person, you confirm that you are authorized to do so.

You grant The Million Dollar Tesla LLC a nonexclusive, royalty-free license to reproduce, resize, make production adjustments to, print, install, display, photograph, and promote the approved artwork in connection with the Million Dollar Tesla project, including on the vehicle, project website, social media, and related project materials.

You are responsible for claims arising from your artwork or your breach of these promises. To the extent permitted by law, you agree to defend and indemnify The Million Dollar Tesla LLC and its project contractors against third-party claims and reasonable legal costs arising from those matters, except to the extent caused by MDT’s use of the artwork outside the permission granted above.

MDT may request proof of permission and may reject or remove artwork if a rights concern arises.

The journey

The vehicle will be driven across the US for a planned 50,000 miles. Routes will change regularly. Since we must account for weather, traffic, environmental factors, and other elements outside of our control, there is no guarantee that the vehicle will be in any position at any specific time.

We will drive the car through all 48 contiguous states (Alaska and Hawaii excluded), with stops at every state capital in those states as a minimum guarantee.

Liability

Our total liability to you is limited to the amount you paid for your artwork placement.

Continuity

You retain ownership of your artwork. By submitting it, you grant The Million Dollar Tesla LLC a nonexclusive, royalty-free, transferable license to display the approved artwork on the vehicle and in photographs or recordings of the vehicle.

You agree that this display license may transfer with the vehicle to its purchaser at auction and any later owner, who may continue displaying the artwork on the vehicle for the remainder of the five-year display term, including at the required public appearances. No additional permission or payment from you is required for that continued display. The license does not permit use of your artwork separately from the vehicle or to promote unrelated products or services.
